Terms & Conditions

User Agreement

Please read this agreement carefully before accessing or using the information and services available through the marinetrader website. By accessing or using the website, you agree to be bound by the terms and conditions below. marinetrader may modify this agreement at any time. Any such modifications shall be effective immediately upon posting the modified agreement on the site. You are responsible for ensuring you are up to date with our latest terms and conditions.

General

1. Marinetrader NZ Limited provides the marinetrader website and services so that you can 1) post items for sale by means of a classified listing or by running an auction, 2) bid on items for sale or purchase items through classifieds and interact and transact directly with other members of marinetrader. marinetrader is not a party to any of these transactions, and will not become involved in resolving disputes between members about transactions.

2. You shall not list your contact details, email addresses, phone numbers or other contact details in any of your listings, comments, feedbacks, forums or in your member profile.


3. In no event will marinetrader be liable to you or anyone else for any decision made, or loss or damage caused to you directly or indirectly, in reliance upon any information contained on or omitted from this site.

4. marinetrader has no knowledge and makes no representations or warranties about any aspect of any listing or member of marinetrader.

5. marinetrader provides no warranty or guarantee for the accuracy of information provided by marinetrader.

6. marinetrader provides no warranty to you that the services generally available through its site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that marinetrader cannot and does not guarantee or warrant to you that files available for downloading through the site or delivered via electronic mail through the site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the site for the reconstruction of any lost data.

7. Members of marinetrader are solely responsible for the content of their listings.

8. A failure by marinetrader to exercise a right under this User Agreement does not amount to a waiver of the right.

9. You must not use the services provided by marinetrader to promote items for sale outside of the website.


10. marinetrader owns all proprietary and intellectual property rights in the website (including text, graphics, logos, icons and sound recordings) and the software and other material underlying and forming part of the services and the website. You may not without our prior written permission, in any form or by any means adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of this website.

Membership information

1. To become a registered member, you must provide a password, email address, phone number and a Username. You are entirely responsible if you do not maintain the confidentiality of your password and user name. Furthermore, you are entirely responsible for any and all activities that occur under your user name. You may change your password or login at any time by following instructions.

2. You agree not to allow any other person to use the marinetrader website using your account and Username.

3. You agree to immediately notify marinetrader of any unauthorized use of your Username or any other breach of security known to you.

4. Each person or business may have only one membership on marinetrader.

5. You are responsible for any and all actions taken through your membership. marinetrader memberships are not transferable so therefore cannot be traded, sold, lent or leased to other parties.


6. Businesses requesting membership may be required to provide evidence of or proposal for business.

Posting an advert

If you post an advert on marinetrader you agree that:

1. All currency stated is in New Zealand dollars and includes GST. You can only list the item in one category which is the most appropriate category for your item.

2. Your description is accurate and complete, and includes all relevant information about the product for sale


3. Your listing is not inaccurate, misleading or fraudulent;


4. You will not attempt to manipulate a listing by shadow bidding, or by assuming multiple identities;


5. Sellers must be located in New Zealand. Sellers outside of New Zealand are not permitted to list items for sale on marinetrader.


6. You will only list items that you are legally entitled to sell and are in your possession. You will not list or advertise labour or services.


7. All listings must have relevant information about the terms of sale, payment terms, shipping options or methods and who will bear the cost of shipping.


8. You must sell the item to the highest bidder once the reserve price has been met.

9. Listings are not proofed for content before they are screened. marinetrader reserves the right to remove any listings it deems to be unsuitable or are in breech of the user agreement.


Purchasing Listings

When bidding on or selecting to buy now on a listing on marinetrader you agree that:

1. By bidding you warrant that you have the legal right to enter into and complete the transaction.  Once your bid is placed it is not retractable. You must only bid on listings if you intend to buy the relevant item at the price you have entered.


2. If your bid is successful, you must complete the transaction in the manner specified by the seller and in accordance with the terms agreed to. You agree to your email address being supplied to the buyer after the auction has ended.

3. It is a condition on your use of the marinetrader website that you will not either through any act or omission mislead or deceive others.


4. You must make prompt and full payment for any item purchased through marinetrader.


5. You agree that your username and the amount of purchase will be shown publicly on marinetrader.


6. You can not false bid on auctions of friends or families or any other member to raise the price of that auction. Doing this will result in instant termination of you marinetrader membership.


Feedback

When placing feedback on the marinetrader community on other members, you agree that you will not place feedback that:

1. Violates any New Zealand law;


2. Contains another member's actual name or address; or

2. Contains another member's contact information; or

3. Contains insults, profanity, vulgarity, hate speech, disruptive, or hostile comments, or threats of violence.


4. You may only post feedback that relates to a specific transaction that you have made with a direct member.

Fees

1. marinetrader charges fees for the use of the marinetrader website as a venue.

2. Fees for extra listing options are charged when classifieds are listed, and are only refundable if the refund process is followed and marinetrader accepts that a refund is appropriate in the circumstances.

3. Fees are charged for placing listings or advertisements and are only refundable if the refund process is followed and marinetrader accepts that a refund is appropriate in the circumstances.

4. All fees paid by New Zealand resident members include GST and are in New Zealand dollars.


Marinetrader Accounts
 
1. marinetrader maintains credit accounts for each member to pay in advance to cover fees occurred in listing items for sale. marinetrader accounts can not be used to pay for items purchased through marinetrader.

2. If your membership is terminated, marinetrader will refund the balance of your account less a $3 manual transaction fee. If your balance is less than $3, no money will be refunded.

3. You must make payments to your account before using any features of marinetrader that incur fees. You must settle any negative account balances immediately. marinetrader reserves the right to take action against you to recover any outstanding debts. You will be liable for all expenses incurred by marinetrader whilst collecting debt.

Resolution of disputes

Marinetrader is not a party to any transaction or sale that takes place between members; therefore, you agree not to involve marinetrader in any disputes that may arise between members.

Traderchat

Marinetrader provides forums for members to post topics, participate in online discussions and post personal tips and tricks. You must not post information in the forums that;


1. Violates any New Zealand law;

2. Contains another member's actual name or address; or

3. Contains another member's contact information; or

4. Contains insults, profanity, vulgarity, hate speech, disruptive, or hostile comments, or threats of violence.

Marinetrader will not be responsible for any information posted on the forums, we will monitor this area and if you are found to be abusing this service, or any of the user agreements your membership will be instantly terminated.
